Operation of Service

Privacy and storage of data

In order to provide the SODA3™ email filtering service we need to store your POP3 account details, as well as your list of "accepted" email addresses. This information is stored on our servers, and may need to be accessed by comcetera ltd for the purposes of maintaining the SODA3™ service. This information will never be used for any purpose other than for providing the SODA3™ mail filtering service, as advertised on www.soda3.com, nor passed to any third party under any circumstances unless required for legal or law enforcement purposes.

The SODA3™ service retrieves and relays your email from your email account, performing filtering based on the header information contained within those emails. Other than for the purpose of relaying your email to you, your email will not be intercepted, made available to any third party, or used for any purpose other than for filtering and relaying to you, nor is any record of your email, or its senders, stored on our systems, other than the list of accepted senders which you provide us with.

We keep basic logs of website access for purposes of server maintenance.

Other than the details listed above, no other personal details or records are kept.

Authorisation of email server access

Use of the SODA3™ service, and provision of your email settings and passwords through our pop3 service implies you give your permission for the SODA3™ server(s) to access the email server(s) you specify, for the purposes of providing the email filtering service as advertised on http://www.soda3.com, and that you are authorised to give permission to access the accounts specified.

Responsibility of use

You agree not to use the SODA3™ service to access email accounts which you are not authorised to access. You agree not to use the SODA3™ service for any illegal, immoral, or improper purpose. If any users are found to be, or suspected to be using the service for any illegal, immoral, or improper service, or in a way which could impede or impact the use of the service by legitimate users, the related accounts will be terminated without warning or refund. Any details required by, or which should morally be provided to law enforcement agencies as a result of such actions will be disseminated as deemed appropriate by comcetera ltd.

By using the service, you accept full responsibility for the transfer of any mail or data through the service, and agree to protect comcetera ltd from any legal repercussions of your use of misuse of the service.

Availability of service

The SODA3™ email filter service is provided as-is, without any warranties, express or implied, of its merchantability, or suitability or fitness for any purpose.

Although every reasonable effort will be made to ensure continuous and uninterrupted service, we do not guarantee that the SODA3™ service will be available for use at any specific time. Use or attempted use of the service implies agreement that comcetera will not be held responsible for any loss or damages arising from your use, misuse, or inability to use the services advertised, even if we have been advised of the possibility of such loss. We reserve the right to terminate or modify the service offered at any time, without notice, with refunds offered for incomplete subscriptions at the sole discretion of comcetera ltd.

Interpretation

These terms shall be governed by United Kingdom law. Where an error, grey area, or potential loophole exists in the wording or layout of these terms, they shall remain legally binding for the meaning which it can be seen, by common sense of a judge for the United Kingdom legal system, that they were intended.
